![]() We are acutely aware of the absence of warning systems which can tell the Bank when a debt becomes ‘bad debt’ and how bad the problem is; when there is the need for urgent action for recovery or when there is hope for a way out of trouble for both the Bank and its customer. We are here to offer a partnership service for Banks to assess the value of properties in arrears but more importantly to paint a picture of the reason behind the debt. Our analysis will help you discover where the problem lies, the extent of the problem and, finally, we can provide the solution to debt recovery. Our work begins with a Pre-possession Report which sets out the current Market Value of the property or portfolio of properties, with a history of the debt and a forensic analysis of the situation. The assessment results in a Risk Reduction Assessment of the debt which will lead to three broad courses of action; ![]() 1. Where the Bank’s customer is co-operating we suggest recovery of the debt by refinancing or advising the Bank’s customer to adopt an action plan to resolve the issues identified in the Pre-possession Report, in agreement with the Bank. 2. Where the debt cannot be repaid and the Bank's customer cannot or will not co-operate we will advise and carry out possession orders to repossess the asset and sell to recover the debt. 3. In cases where difficulties arise with properties or clients, involving complicated Landlord & Tenant Law, tenancies, unfinished development sites, problems in planning or structural concerns the last resort is Law of Property Act Receivership.
